Clear news, evident confusion. Why are such delicate collective decisions left to the judiciary? It’s evident that different judges may reach different conclusions.

Last March, for example, the Court of Appeal in Pistoia had recognized the legitimacy of recognition by both mothers. So, will children born in Tuscany have two mothers, while those in Lombardy have only one? The same Court of Appeal in Milan, in its decision, notes that the matter “requires the intervention of the legislator,” who is, however, lagging behind.

Why? Very easy answer: because the issue is delicate and does not lend itself to the simplifications loved by politics. On ethical issues, Italians often reveal themselves to be surprising, and every pattern risks falling apart: right/left, believers/non-believers, young/old.

The appropriate tool for these matters would be a referendum, but it takes time, and radical bulimia has emptied it of meaning and importance. Therefore, it is up to Parliament. Do our deputies and senators not complain about having lost importance?

Here is a noble way to regain it. There is not only the issue of recognizing the children of same-sex couples; there is also end-of-life, on which the Constitutional Court had to intervene. While waiting for the legislator to find the courage, it would be good to remember one thing: when dealing with these issues, caution and sensitivity are necessary.

Love does not always follow the code, but the code should always follow love. Oppositions from talk shows are harmful in these matters. In fact: offensive.

Those who know female couples know how much they love their children: neither more nor less than any other couple. “The mother who did not give birth has no genetic ties to the children!” someone protests.
